This provision is reason alone to toss the whole works down the crapper.

This also might be a blessing in disguise. Don’t plaintiffs have to demonstrate concrete evidence they have been harmed. Wouldn’t the trial lawyers have to prove that GHGs were capable of producing the alleged harm?
